Visicom Maps User Agreement
1. Subject of the User Agreement
1.1. The subject of this User Agreement ("Agreement") is the relationship between Visicom JSC, hereinafter "Visicom", which is the copyright holder of the website located on the Internet at https://maps.visicom.ua, (hereinafter "Website" or "Site"), and You (an individual, Internet user), hereinafter "User", regarding the use of the Website. By using the Site, the User agrees to comply with the terms described in this Agreement. The Agreement may be modified without any special notice.
1.2. The Agreement regulates the procedure for using the Site. The provisions of this Agreement are mandatory for all Users who have started using the Site. The User can familiarize themselves with the current version of the Agreement by following this link: https://api.visicom.ua/ru/docs/maps-agreement.
2. Description of the Site
2.1. Visicom provides free access to a complex of cartographic websites, accessible via personal computer and various mobile devices, both currently existing and those to be developed in the future.
2.2. The User understands and agrees that the Site may contain advertising, and that the presence of such advertising is a necessary condition for using the Site. The User also understands and agrees that the Site may contain messages from Visicom, such as service messages, automatic notifications, and Visicom newsletters.
2.3. The Sites are provided "as is". Visicom is not responsible for the Site's compliance with the User's purposes. All issues of granting access to the Internet, purchasing and installing appropriate equipment and software products for this purpose are resolved by the User independently and are not subject to this Agreement.
2.4. The User agrees that Visicom may collect depersonalized statistical data about Site Users.
3. Entry into Force of the User Agreement
3.1. This Agreement, as well as amendments and additions to this Agreement, enter into force from the moment of their publication at https://api.visicom.ua/ru/docs/maps-agreement. The User's consent to the terms of the Agreement is expressed through actual use of the Site.
3.2. The User has the right to refuse to accept the amendments and additions to the Agreement introduced by Visicom, which means the User's refusal to use the Site.
4. Use of the Site. Individual Site Functions
4.1. The Site uses intellectual property objects, the rights to which belong to the respective copyright holders, as well as information provided by its owners. The list of copyright holders and other copyright information can be found in the document: Copyright Statement.
4.2. Any information used on the Site, including cartographic materials and data about points of interest, hereinafter "Data", is intended exclusively for personal non-commercial use. At the same time, any copying of data, its reproduction, processing, distribution, communication to the public (publication) on the Internet, any use in mass media and/or for commercial purposes without prior permission from the copyright holder is prohibited, except in cases directly provided for by this Agreement.
4.3. The Site provides the User with the functional capability to automatically build routes on maps indicating a variant of the path from the departure point to the destination specified by the User, hereinafter "Route".
4.4. The User independently and fully assumes all risks and responsibility for choosing the Route and following it. Visicom does not guarantee the correctness, optimality, relevance and/or compliance of Routes with traffic rules and is not responsible for the User's choice of Route and following it.
4.5. The User undertakes not to commit any intentional actions that may cause harm to Visicom or third parties and cause damages of material, intellectual, or other nature.
4.6. Visicom reserves the right to change/correct, update both cartographic information and certain Site functions at any time at its own discretion and without prior notification to the User.
4.7. Visicom reserves the right at its discretion to limit the User's access to the Site (or to certain Site functions, if technically possible) in case of repeated violations of this Agreement, or apply other measures to the User, in order to comply with legal requirements or the rights and legitimate interests of third parties.
5. Interruptions in Service Provision
5.1. Visicom has the right to conduct maintenance work with temporary suspension of the Site's operation.
5.2. In case of force majeure circumstances, as well as accidents or failures in software and hardware complexes of third parties cooperating with Visicom, or actions of third parties aimed at stopping or terminating the functioning of all/part of the Site, cessation of work is possible without prior notification to Users.
6. Feedback and Dispute Resolution Procedure
6.1. Regarding Site operation issues, the User may contact User Support Service at the email address: web-maps@visi.com.ua, as well as at other Visicom user support addresses.
6.2. Inaction on the part of Visicom in case of violation by the User or other third parties of the Agreement provisions does not deprive Visicom of the right to take appropriate actions to protect its interests in the future.
6.3. The User and Visicom agree that all possible disputes regarding the Agreement will be resolved in accordance with the norms of current legislation of Ukraine.
7. Additional Information
7.1. Unlimited use of Visicom map fragments on the Internet obtained using existing Site functions is permitted. At the same time, the User does not have the right to remove, hide, or modify copyright protection marks, as well as any active links.
7.2. Unlimited free use of map fragments, as well as their derivatives (with additions, abbreviations, changes, and other modifications) in mass media, printing, outdoor advertising, and other printed and electronic publications is permitted — subject to the presence of a caption for each fragment of the type shown below. The font size used for captioning fragments in printed publications and printing must be at least 5 points, in outdoor advertising — at least 2% of the layout area.
